Telangana HC slaps Rs 50,000 fine on man who misused Habeas Corpus

Hyderabad : The Telangana High Court on Wednesday slapped a fine of Rs 50,000 on the petitioner who filed a Habeas Corpus seeking the production of a woman, allegedly kept in captivity by her parents.

The division bench comprising of Chief Justice Raghavendra Singh Chauhan and Justice A Abhishek Reddy imposed fine on V Mallesh, a resident of Ranga Reddy district, for misusing the process of law and asked him to pay the amount within two weeks.

The brief facts of the case are that on August 10, the Saroornagar police, based on the complaint of the woman, registered a case against V Mallesh for stalking, threatening, and blackmailing, when they were in a relationship. The police arrested the accused on August 13, and the court had remanded him to judicial custody.

Mallesh filed a petition alleging that her father and brother-in-law forcibly detained the woman, Ashwini, and they forcibly made her file a false complaint against him. The court directed the police to produce the alleged victim, and she was presented before the judges at the start of court proceedings on Wednesday. Both judges interacted heard the woman and passed the order imposing Rs 50,000 fine on the petitioner for misusing legal procedures.
