N. Vijaya Lakshmi approached Renuka Sahasra Projects to purchase a plot of land and paid Rs. 1,70,000 in four instalments. Renuka Sahasra Projects allotted plot no. 205 (302.5 sq. yards) situated at Bhuvanagiri in Nagirepally.
After paying the amount, Lakshmi and her husband approached the opposite party to register the land. However, Renuka Projects failed to register the plot and did not develop the land as they had promised at the time of payment.
After registering a complaint, the consumer commission notice was forwarded to Renuka Sahasra Projects but they refused to accept the notice.
The commission observed that Renuka Sahasra Projects demanded an extra amount to develop the land, and dodged the registration on one pretext or the other. Also, they refused to take the notice sent by the commission. "Refusing of the notice itself shows that Renuka Sahasra Projects does not have any intention of answering to the allegations levelled against it. In the absence of any explanation from them, it is clear that with a malafide intention they have collected the amounts from the complainant and failed to register the plot in her name," observed the commission.
The commission asked Renuka Sahasra Projects to refund Rs. 1,70,000 to the complainant, pay Rs. 1 lakh as compensation for causing mental agony and inconvenience, and Rs. 5,000 towards the costs of the litigation.
