A Single Bench of Justice Nagesh Bheemapaka passed the orders while adjudicating the writ petition filed by R Mallesh and three others from Amberpet, Hyderabad, seeking a direction to the TSSPDCL to acquire their land admeasuring 2,432 square yards land, out of which 300 square yards was utilised by the TSSPDCL (Telangana State Southern Power Distribution Company Limited) to construct 33/11 KV Sub Station in Amberpet.
Rapolu Bhaskar suppressed the facts that the petitioners, though not in possession of the said land, had informed the court that they owned the subject land and there was a house in a dilapidated condition, thereby misleading the court.
Further, the petitioners had filed a civil suit in the lower court and withdrew it after dragging the issue for eleven years, which the fact was also concealed by the petitioners.
The court observed that the advocate representing the petitioners had approached the court with unclean hands and suppressed material facts thereby misleading the court.
