Kurnool: The District Consumer Disputes Redressal Commission, Kurnool, has taken a stern view of the continued non-compliance of its order and issued Non-Bailable Warrants (NBWs) against Amazon and two associated sellers for failing to refund money or replace a product wrongly delivered to a consumer.
iPhone order turns into wrong delivery
The case stems from a complaint filed by K Veeresh, a resident of C Belagal village and mandal in Kurnool district. Veeresh had ordered an Apple iPhone 15 Plus (128 GB, Yellow) through Amazon on September 29, 2024, paying Rs 79,900.
However, instead of the iPhone, he received an iQOO Neo 9 Pro handset. Despite repeated complaints, neither Amazon nor the sellers resolved the issue or refunded the amount.
Commission’s directions ignored
After hearing the case (Consumer Complaint No. 08/2025), the Commission had directed Amazon (Opposite Party No. 1) and its sellers — Clicktech Retail Pvt. Ltd. and Trilokeshwar Estates Pvt. Ltd. (Opposite Parties No. 2 and 3) — to jointly and severally replace the iPhone or refund Rs 79,900 with 12 per cent interest per annum.
It also ordered payment of Rs 25,000 as compensation for mental agony and Rs 10,000 towards litigation costs, to be complied with within 45 days of the order.
Execution petition filed after non-compliance
When the order was ignored, Veeresh filed an Execution Application on August 18. Notices were issued to all opposite parties on August 26.
While Amazon’s counsel entered an appearance by filing a vakalath, the other two sellers did not appear or respond. Despite three opportunities granted by the commission, there was no compliance or explanation from any of the opposite parties.
Commission takes stern action
Finding deliberate defiance of its directions, the commission, on October 22, ordered issuance of Non-Bailable Warrants (NBWs) against Amazon and both associated sellers.
The matter has been adjourned to November 21 for further proceedings.
