Ashritha Group in Miyapur fined Rs 3 lakh for withholding flats
Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) has penalised Ashritha Group Rs 3 lakh and ordered it to register two flats in favour of homebuyers who were denied their rightful possession despite valid agreements.
Flats booked in 2021
The order followed complaints by Srinivasulu Bode and C Malleswari Nandireddy, residents of Miyapur, who booked two flats in the āJewels Countyā project in 2021. The project, located in Hyderabad, was approved by the HMDA and registered with RERA.
Buyers allege harassment
According to the complainants, the builder failed to honour the agreement terms, retracted earlier receipts and created confusion over payments. Despite repeated notices and follow-ups, Ashritha Group allegedly refused to resolve their concerns and even threatened to cancel their agreements.
RERA verdict
Holding Ashritha Group accountable under Section 11(5) of the Real Estate (Regulation and Development) Act, 2016, TGRERA directed the builder to register the flats in favour of the complainants upon receipt of dues as per the agreed milestone-based payment schedule.
Builderās defence rejected
The builder argued that the agreements were cancelled due to payment defaults and claimed that refunds were offered to the buyers, who failed to respond. However, TGRERA found the builderās actions in violation of statutory obligations and partly allowed the complaints.
The authority imposed a Rs 3 lakh fine on Ashritha Group and directed that the amount be deposited into the RERA fund within 30 days.
