Raja Singh, filed a writ petition in the Telangana High Court on 5 September to quash the preventive detention order filed against her husband. Further, Ms. Usha Bhai submitted that the order of preventive detention approved by the principal secretary, general administration (law and order), is illegal, arbitrary, contrary to the law, and in violation of Articles 14 and 21 of the Constitution of India.
She brought to the notice of the court that Hindi is the mother tongue of the detenu Raja Singh. He is not conversant with English and Telugu. Further, he can read and write in Hindi only, she said. The material papers served to Raja Singh show that the orders of detention and grounds of detention are served in English, Telugu, and Hindi, and all the material papers served are in English and Telugu only.
Further, Ms. Usha Bhai submitted that there are a number of mistakes in Hindi when compared to the detention order in English. The supporting materials supplied along with the grounds of detention are in English and Telugu. The detenu is deprived of making effective representation on the detention order as he is deprived of knowing the contents of the supporting material enclosed on the grounds of detention.
Moreover, Ms. Usha Bhai prayed the court to direct the respondentsāprincipal secretary, GAD (law and order) and the commissioner of Hyderabad policeāto release Raja Singh who is now lodged in Cherlapally central prison, Medchal-Malkajgiri district, by suspending the preventive detention order and setting him free.
The plea may come for hearing before the Bench within a day or two.
