Hyderabad: District Consumer Disputes Redressal Commission has dismissed a consumer complaint filed by Samudrala Vishnu against PURE EV, an electric vehicle company.
The complaint, which sought a new battery replacement under warranty along with compensation of Rs 3,00,000 for damages, Rs 5,00,000 for mental agony, and Rs 90,000 toward the price of the scooter, was rejected due to lack of evidence and failure to follow the service schedule as per the user manual.
The case was adjudicated by the Commission, presided over by Vakkanti Narasimha Rao (President), along with D Sri Devi (Member) and V. Janardhan Reddy (Member). The panel ruled that the complainant failed to substantiate claims of defective service with reasonable doubt and independent expert evidence.
Additionally, the Commission noted that the complainant did not avail the free services mandated under the user manual. The battery in question was beyond the warranty coverage period, and despite purchasing the vehicle on April 7, 2021, the complainant issued a legal notice only on December 10, 2023, without availing any of the scheduled free services.
The lack of adherence to service schedules, as required for warranty claims, led to the dismissal of the complaint. The Commission further stated that mere allegations without substantial documentary evidence do not constitute a deficiency in service by the opposite parties.
As a result, the complaint was dismissed, reinforcing the importance of maintaining vehicles as per the user manual and availing timely free and paid services to ensure warranty coverage. The ruling serves as a reminder for electric vehicle owners to adhere strictly to service schedules prescribed in the user manual to avoid warranty disputes in the future.
