Governor’s rejection of MLC nomination: Telangana HC to decide on maintainability of Dasoju, Kurra’s petitions
They were nominated to the Upper House by the previous BRS government
By Newsmeter Network Published on 6 Jan 2024 2:56 AM GMTHyderabad: Telangana High Court will decide on the maintainability of writ petitions challenging the governor’s decision to reject the nomination of two BRS leaders to the Legislative Council.
On Friday, a division bench of Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti heard the two writ petitions filed by Dr. Dasoju Sravan Kumar and Kurra Satyanarayana seeking suspension of GO wherein their names were rejected by the governor.
They were nominated to the Upper House by the previous BRS government.
The court said that it would adjudicate on the aspect of maintainability on the next date of hearing and directed the senior government counsel appearing for the secretary to the governor and the counsels for the petitioners to file their objections.
Aditya Sondhi, senior Supreme Court counsel representing Dr. Dasoju Sravan Kumar informed the court that the governor has no such discretion under Article 171(5) to reject the nomination.
He said the governor has to decide on the aid and advice of the council of ministers
He further informed the court that the governor could have sought information on the candidates. He said there is no report from the Intelligence department which could have led to rejection.
Mayur Reddy, a senior counsel, appeared for Kurra Satyanarayana.
The case was adjourned to January 24.
