HC adjourns pleas seeking to quash case against BRS minister Srinivas Goud
The matter was referred to police by the sessions court which alleged that Goud, MLA from Mahabubnagar, had “tampered” with the election affidavit by suppressing facts
By Newsmeter Network Published on 15 Sep 2023 2:44 AM GMTHyderabad: On Thursday, The Telangana High Court adjourned two criminal petitions seeking to quash the case registered against BRS minister V Srinivas Goud and other election officials. The two petitions seeking quash FIR No 241/2023 were listed before Single Bench, comprising Justice T Vinod Kumar, for hearing at 4 pm, but the cases couldn’t reach for hearing. Subsequently, the pleas were posted for hearing on September 19.
The plea was filed by Rajendra Prasad, a notary advocate, a resident of Mahabubnagar (accused No 10 in FIR No 241/2023), registered at II Town PS, Mahabubnagar. The plea was filed by D Ronald Rose, IAS former district collector and district election officer, Mahabubnagar, J Srinivas, additional collector Nalgonda, former RDO, Mahabubnagar, A Padmasree, Medak and former deputy collector-cum-RDO, Mahabubnagar and S Venkat Rao, collector, Suryapet and former district collector, Mahabubnagar district.
Earlier, the special court directed the station house officer (SHO) of Town II police station in Mahabubnagar district to register a case against Srinivas under section 156(3) of CrPC and start an investigation. The matter was referred to police by the sessions court on a private complaint which alleged that Goud, MLA from Mahabubnagar, had “tampered” with the election affidavit by suppressing facts.
The FIR was registered on August 11 against Telangana excise minister V Srinivas Goud, CEC Kumar and a host of other officials after being referred by the sessions court for allegedly “tampering” Goud’s 2018 state assembly election affidavit. While Goud was named as the first accused, CEC Kumar and several other officials were made co-accused, who the complainant alleged had colluded with the minister and closed the election affidavit without taking any further action.
Later, the Telangana High Court placed under suspension a special sessions judge in connection with a ‘direction’ given by him to police for registering an FIR against Chief Election Commissioner Rajiv Kumar and several others, saying the judge acted in ‘undue haste’.
