Telangana HC notice to Nalgonda collector for allotting govt junior college land to market complex.

Hyderabad: The Telangana High Court Division Bench comprising Chief Justice Ujjal Bhuyan and Justice N Tukaramji on Tuesday stopped the Nalgonda district collector T Vinay Krishna Reddy, from allotting two acres, which belong to the Government Junior College for Boys in Devarakonda, Nalgonda district, for the construction of an integrated veg and non-veg market complex, as part of a state government programme.

As per the case, the Nalgonda district collector, on December 9, 2022, had directed the tahsildar, Devarakonda, to hand over two acres of land, in survey numbers 751/2 and 757/2, belonging to the government college to the municipal authorities.

The Chief Justice Bench directed the district collector, Nalgonda ā€œto not alienateā€ the two acres to the municipal authorities and issued notices to the chief secretary, principal secretary revenue, commissioner Intermediate Education, Nalgonda district collector, principal of Junior College for Boys in Devarakonda.

Further, the court directed them to respond to the notices and furnish reasons for the particular allotment, despite the fact that the commissioner of Intermediate Education had written to the collector on February 8, 2023, opposing the decision stating that such a move would cause great inconvenience and hardship to the students studying in the college.

Chief Justice Ujjal Bhuyan, while passing the restraint order, quoted the Division Bench order issued on March 31, 2022, while adjudicating PILs opposing the move of Medak collector, who had a similar proposal. The Chief Justice Bench had stayed the land allotment in that case too.

Later, the Medak collector had an affidavit before the High Court assuring the court that the land of the government junior college would not be alienated for other purposes. Terra Rajnikanth Reddy, counsel for the petitioner, argued and vehemently opposed Nalgonda Collectorā€™s move.

The Division Bench was adjudicating the PIL filed by Tutulli Ravi Kumar, advocate from Devarakonda. The case was adjourned to August 18, 2023.
