Hyderabad: Agarwal Packers and Movers asked to pay Rs 75K for delayed delivery

Hyderabad: District Consumer Redressal Commission-III, Hyderabad has directed Agarwal Fastway Logistics Packers and Movers ( AFLPM) to pay Rs 50,000 for the delayed delivery of the goods to a Hyderabad resident.

The Commission has also asked the firm to pay Rs 20,000 towards damage to goods and Rs 5,000 towards the cost of litigation.

Case details

On July 25, 2022, Vivek Kumar, an Army staff and a resident of Mehdipatnam Cantt, Hyderabad paid Rs 64,500 to Agarwal Fastway Logistics Packers and Movers to get his household goods shifted from Una Himachal to Hyderabad. Vivek Kumar reached Hyderabad on July 30, 2022, and the firm told him that his goods would arrive in one or two days. But household goods were not delivered to Vivek Kumar even after four to five days.

Packers and Movers delayed the delivery of items to Vivek Kumar

Vivek Kumar called the firmā€™s number multiple times which was switched off and he stayed with his three-year-old daughter and wife without luggage for almost 20 days. Vivek Kumar and his family suffered a lot and at last received his household items on August 21, 2022. He had lost some of those items. When Vivek Kumar questioned the firm about the delay and missing items, they did not respond and even switched off their phones.

Vivek Kumar received their luggage almost 20 days later

Vivek Kumar received his luggage after almost 20 days and it was soaked in water and without packing. The luggage was also broken. He immediately hired an advocate and paid Rs 48,000 to him to fight against the firm that did not give proper service to him. With no option left, he knocked on the doors of the Consumer Forum for justice. Despite serving a legal notice to the firm on January 29, 2024, it failed to appear and respond within the stipulated period.

After going through the evidence submitted by Vivek Kumar, the Court noted that Agarwal Fastway Logistics Packers and Movers has indulged in unfair trade practice and committed grave deficiency in service under the Consumer Protection Act, 2019 and has caused immense mental agony, discomfort, and harassment to Vivek Kumar.

The Court asked the firm to pay an amount of Rs 20,000 for damage to goods, Rs 50,000 for causing mental agony and financial hardships, and costs of Rs 5,000 to Vivek Kumar.
