Hyderabad: Ranga Reddy District Consumer Disputes Redressal Commission (DCDRC) has directed Club Resorto Vacations Private Limited to refund Rs 1.75 lakh with 9 per cent annual interest to a Hyderabad man for not fulfilling the commitment of returning money after cancelling a holiday membership.

The panel also ordered the company to pay Rs 10,000 as compensation for mental harassment and Rs 5,000 towards litigation costs. The commission warned that non-compliance within 45 days would attract an additional penalty of Rs 10,000.

Luxury holiday package purchased

The complainant, Jaya Prasanna Kumar, a resident of Pragathi Nagar, had purchased a 10-year luxury holiday package from the company on February 5, 2023, by paying Rs 1.75 lakh.

At the time of enrollment, company representatives allegedly assured him that the entire amount would be refunded in case the membership was cancelled for any reason.

Membership cancelled within 24 hours

According to the complaint, Kumar sought cancellation within a day of purchase, citing health issues faced by his wife. He communicated his decision through WhatsApp, to which the company replied that the cancellation would be processed immediately. Despite the assurance, the firm failed to return the amount.

Legal notice ignored

After multiple follow-ups yielded no result, the complainant issued legal notices to the company. With no response forthcoming, he approached the district consumer commission, alleging a deficiency in service and unfair trade practice.

Company found guilty of deficiency

After hearing both sides and examining the evidence, the commission held the company guilty of violating consumer rights by withholding the refund despite accepting the cancellation request.

Strict deadline for compliance

After hearing the arguments from both parties, the commission pronounced its verdict in favour of the complainant. It also clearly stated that failure to comply with the refund order within 45 days would invite an additional penalty of Rs 10,000, apart from the ordered compensation and legal costs.
