Hyderabad: Hyderabad City Civil Court's Motor Accident Claims Tribunal (MACT) has awarded ₹1.14 crore compensation to the family of a railway employee who died in a road accident in 2022.

The tribunal held that the accident occurred due to the negligence of a lorry driver and directed the insurance company to pay the compensation amount first and later recover it from the vehicle owner.

Accident caused by negligent driving

The deceased, Amarjeet Kumar Yadav, a native of Samastipur in Bihar, was working as a Goods Guard in the Railways. On June 24, 2022, he was travelling on a two-wheeler from Sanathnagar towards Chintal in Hyderabad when a speeding lorry rammed into him from behind.

Yadav fell onto the road, and the lorry ran over him, resulting in his death on the spot. Following the incident, the Jeedimetla police registered a case, concluding that the accident was caused by the rash and negligent driving of the lorry driver.

Tribunal considers income and prospects

Yadav’s family members, who reside in Bihar, approached the tribunal seeking compensation, stating that he was the sole breadwinner of the family.

After examining the evidence, the tribunal calculated the compensation by taking into account his annual salary, future income prospects, and the financial dependency of the family.

Insurance firm to pay first, recover later

During the proceedings, the insurance company argued that the lorry driver’s transport endorsement on the licence had expired, seeking to avoid liability.

However, the tribunal rejected the argument and, citing the Swaran Singh case, ruled that the insurance company must first pay the compensation to the victims’ family and can later recover the amount from the vehicle owner.

Compensation distribution

The tribunal ordered the following distribution of the compensation:

₹39,69,288 (including interest) to the deceased’s wife

₹25 lakh each to his three children

The tribunal directed that the children’s shares be kept in fixed deposits to secure their future.
