Election Commission rejects nominations of 5 candidates; HC refuses to order review
After hearing their contentions, the Division Bench rejected the writ petition and said that it could not interfere in the issue at this stage of elections
By Newsmeter Network Published on 20 Nov 2023 2:53 PM GMTHyderabad: On Monday, the Telangana High Court dismissed a petition to order the Election Commission of India to accept five nominations in the Jubilee Hills Assembly Constituency for the ensuing State Assembly elections.
The five petitioners, Md. Zaheed Khan, Maddi Reddy Ravinder, Gageeti Anjaneyulu, M Anasuya and K Murali Krishna, approached the court after their nominations were rejected.
The Division Bench, comprising Chief Justice Alok Aradhe and Justice NV Shravan Kumar, were informed that the returning officer (RO) of Jubilee Hills Assembly Constituency rejected the five nominations on the grounds of typographical errors and blanks in the nomination papers, which according to the petitioners, can be ignored and an opportunity can be given to them to make corrections in the nomination papers.
In a similar case on Monday, the High Court Chief Justice Bench dismissed the writ petition filed by Sri Kambalapally Ravindra Prasad, a resident of Shirdi Sai Nagar colony, Hastinapuram in RR district, who sought a direction to the returning officer of Ibrahimpatnam Assembly constituency to accept his nomination.
He filed his nomination as an independent candidate. However, the RO rejected his nomination on November 15 on the grounds that the names of the proposers entered and mentioned in the nomination form did not tally with the electoral rolls.
In both cases, the Division Bench rejected the writ petitions and said that it could not interfere in the issue at this stage of elections. āThere is only one remedy and that is by filing an election petition after the elections. There is no remedy provided at an intermediate stage,ā the court said.
