Land compensation: Telangana HC asks collector to pay or face contempt case

Hyderabad: Telangana High Court warned the District Collector, Hyderabad, Special Deputy Collector, Land Acquisition (GHMC), and Commissioner, GHMC that non-bailable warrants will be issued against them if the land compensation orders are not implemented scrupulously by the next date of hearing.

The court told them to appear before the bench on August 3 if they donā€™t comply with the orders.

A division Bench comprising Chief Justice Ujjal Bhuyan and Justice Surepally Nanda was adjudicating a contempt case filed by Mahesh Mohan Lal and five others.

The court had directed the officials to pay compensation for the land measuring approximately 44,359 square yards, located in Bapunagar, S.R. Nagar, Hyderabad. The land was acquired by the Commissioner, Municipal Corporation of Hyderabad under the Slum Improvement (Acquisition of Lands) Act.

Since the petitioners were not paid compensation, they filed a writ petition in 2004 and the court directed the District Collector to take the necessary steps to pay compensation to them within two months from the date of receiving a copy of the order by specifying interest at the rate of 4% per annum for a period of one year from the date the land vested in the government i.e. April 21, 1998.

However, District Collector challenged the single-judge order in 2022, which was dismissed by the division bench.
