MBBS admissions: Telangana HC asks petitioners to produce residence certificates before university

One of the petitioners said that she was born in Hyderabad and claimed to be a permanent resident of Telangana.

Telangana HC asks petitioners to produce residence certificates before university

Hyderabad: Telangana High Court has asked the students, who were denied admission to MBBS over their residential status, to produce the residence certificates before the university.

A division bench of Chief Justice Alok Aradhe and Justice T. Vinod Kumar asked the petitioners to produce a residence certificate issued by the competent authority of the Telangana government before the Kaloji Narayana Rao University of Health Science within one week. The Court said the petitioners shall be treated as local candidates if they produce the residence certificates.

The court was hearing a batch of writ petitions seeking the validity of Rule 3(III)(B) of the Telangana Medical & Dental Colleges Admission (Admission into MBBS & BDS Courses) Rules, 2017 arises for consideration and challenging G.O.Ms.No.114, dated 05.07.2017, on the ground that the same is unconstitutional.

Moreover, the petitioners also sought relief that they be declared as local candidates for the purposes of admission into MBBS/BDS courses for the academic year 2023-2024.

Further, the petitioners claim themselves to be permanent residents of Telangana.

One of the petitioners said that she was born in Hyderabad and claimed to be a permanent resident of Telangana. The petitioner completed her schooling from classes 1st to 10th in Hyderabad Public School, Begumpet, Hyderabad.

The parents of the petitioner are IPS officers and belong to All India Service. In 2017, the father of the petitioner was transferred to Chennai. Thereafter, in 2021, the mother of the petitioner was also transferred to Chennai. On account of the COVID-19 pandemic, it was not possible for the petitioner to stay in the boarding school at Hyderabad since they were shut down.

The petitioner on account of the transfer of her parents to Chennai, pursued her studies and passed her 11th and 12th classes examinations.

Thereafter she appeared in the NEET examination on April 7. The result of the NEET examination was declared on June 13. However, on August 2, Kaloji Narayana Rao University of Health Sciences declared the petitioner as ineligible for admission as a local candidate.

After hearing the contentions of both sides, the court directed the petitioners to produce a residence certificate issued by a competent authority of the Telangana government within a period of one week before the Kaloji Narayana Rao University of Health Science. If they produce, they shall be treated as local candidates.

Needless to say, the University shall consider the claim of the petitioners as local candidates as per their merit for admission to MBBS/BDS courses for the academic year 2023-2024.
