Property dispute: Case registered against BRS MLA Harish Rao’s relatives for trespassing, cheating

Hyderabad: Police have registered a case against BRS MLA Harish Rao’s relatives for trespassing and cheating.
The FIR has been lodged in Miyapur Police Station against Thanniru Gowtham, Boinapally Venkateshwar Rao, Gone Raj Kumar Goud, Garapati Naga Ravi, Jamapanna Prabhavati, Tanniru Padmaja Rao. They were allegedly unlawfully staying on the 5th floor of Dandu Latchi Raju’s property.
In a police complaint, Chitti Babu who is it has been alleged that the accused sold the property through forgery.
Complainant Latchi Raju is the GPA holder of a Residential House in Sy. No.44/1, situated at the Matrusri Cooperative House Building Society, Miyapur Village, GHMC Serilingampally Circle, RR district.
J. Prabhavathi purchased Plot No. 89 measuring 389 sq. yards from Matrusri Cooperative Housing Society Ltd., Miyapur, Hyderabad. These two properties are adjacent to each other.
J. Janaki Rama Raju and DanduLatchi Raju have been friends and shared a cordial relationship.
Given their friendship, DanduLatchi Raju and J. Prabhavathi intended to develop their two plots jointly for multi multi-storied residential complex.
Accordingly, DanduLatchi Raju and J. Prabhavathi obtained the joint building permission order for both plots along with the approved plan. Both gave a contract to JVR Constructions for constructing the building.
In November 2016, Dandu Latchi Raju and J. Prabhavathi along with her husband late J. Janaki Rama Raju approached Karur Vysya Bank Ltd., Miyapur, Hyderabad for a housing loan. Raju handed over the original sale deed to J. Prabhavathi and her husband for obtaining a loan from the bank. The bank later sanctioned a housing loan to Raju and J. Prabhavathi. However, it was not utilized.
Further, while the construction was in progress late J. Janaki Rama Raju, husband of J. Prabhavathi, looked after the construction works of the building by coordinating with the contractor.
While the construction was in progress, the partners of Fasmo Hospitality Services forced Dandu Latchi Raju to enter into a construction agreement with Arching Designers to complete the works. Dandu Latchi Raju and Goni Raj Kumar, one of the partners of Fasmo Hospitality Services acted as parties.
Meanwhile, before obtaining the no-objection certificate, an amount of Rs. 19,72,837 was spent by Raju and J. Prabhavathi to complete the balance work and secure NOC from the concerned authorities.
At that time, Raju paid Rs.10,00,000 to Arching Designers through RTGS. Thereafter J. Prabhavathi and her husband J. Janaki Rama Raju sold out Flat Nos. 102, 202,302,402 to.Fasmo Hospitality Services. They also sold Flat No. 501 on the fifth floor to .T. Padmaja Rao.
It was alleged unregistered supplementary agreement was prepared by J. Prabhavathi and her husband in collusion with the partners Fasmo Hospitality Services for obtaining an occupancy certificate from the GHMC.
After the purchase of the flats, Fasmo Hospitality Services in collusion with J. Prabhavathi obtained the occupancy certificate and carried out certain further works.
Fasmo Hospitality Services has asked Dandu Latchi Raju to pay Rs.8,28,000. They said they had incurred the money to obtain the necessary clearance and occupancy certificate. They said an amount of Rs.11,06,000 was paid towards the compounding fee for the GHMC for the entire property including the property of Dandu Latchi Raju.
Fasmo Hospitality Services and its partners forcibly obtained the cheque for Rs.2,73,000 without the name of the payee. They also obtained blank Promissory Notes towards security.
Fasmo Hospitality Services and its partners illegally trespassed and occupied flats. When Dandu Latchi Raju questioned the illegal acts, they threatened him with dire consequences.
Fasmo Hospitality Services later entered into a lease Agreement with Fiitjee Limited represented by Garapati Naga Ravi for running hostel accommodation without any registered purchase document.
Either of the owners cannot sell the flats to third parties independently without obtaining the signatures of the other owner.
After hearing the petitioner, the court directed Miyapur police to register a case. Police later booked four persons for criminal trespass under section 420, 448, 504, and 506 r/w 34 IPC.
