Telangana government suffered a major setback after the High Court set aside the detention order of BJP MLA T. Raja Singh and ordered his release.
Hearing the petition filed by the detainee's wife Usha Bai, Justice Abhishek Reddy, and Justice Juvvadi Sridevi ordered Raja Singh's release.
In the plea, Usha Bai urged the court to quash the Preventive Detention order and set free Raja Singh.
The Court directed the government to set free T. Raja Singh at liberty forthwith in case he is no longer required in any other criminal case and subject to the conditions.
The Court directed that only the counsel, Raja Singh's wife, and four family members shall be present inside or outside the jail when he is released.
Further, the Court said that no press meets, no derogatory remarks, and no rallies and processions shall be allowed.
Moreover, Singh shall not participate in or hold any celebratory rallies or meetings after his release.
Further, he shall not give any interviews to any kind of media houses including print or electronic media.
In the future, Siingh shall not make any provocative speeches against any religion or post any derogatory or offensive posts on any social media platforms like Facebook, Twitter, Whatsapp, Youtube, etc., the court said.
Additionally, the Court set these conditions in addition to the restrictions already imposed by the Additional Chief Metropolitan Magistrate, Nampally.
Earlier, Counsel for the petitioner L. Ravichandra submitted that the photo copies served to Siingh were not clear and readable. Due process was denied to Singh, he argued.
The Counsel said when the detainee says that he doesn't know English, how can they serve the copies in the same language? The documents which have been translated into Hindi do not have reasonable content.
The translation is nothing but fabricated, concocted and baseless.
CDs are of no use. The Counsel said Singh cannot watch and hear it in jail.
On 22 August, Raja Singh posted a controversial video on Shree Ram Telangana, a YouTube channel, where he made derogatory comments about Prophet Muhammad. The Hyderabad police said he had done this with the intention to provoke all sections of people and thereby cause a breach of peace and public tranquillity. The BJP disciplinary committee issued a show cause notice and suspended him from the party.
Raja Singh was arrested by the police on August 23rd but was given bail due to a technical glitch of the Hyderabad police. He was then arrested on August 25th for provocative speeches and intimidation in old cases. A total of 43 cases are listed against him in different police stations in Hyderabad which include rioting, house-breaking, and promoting enmity between different groups of people on the basis of religion, caste, race, place of birth, residence and others.
