Telangana HC slams BMC for failing to curb illegal constructions; directs it to take immediate action

Hyderabad: Telangana High Court has come down heavily on the Badangpet Municipal Corporation for failing to curb encroachments and illegal constructions.
The court has directed the civic authorities to take immediate and firm action against violators, even with police assistance if required.
The direction was issued by Justice B. Vijaysen Reddy while hearing a writ petition filed by the American Township Plot Owners Welfare Association, a residents’ welfare body from Balapur, Badangpet.
Residents allege encroachment on Public Road
According to the petition, a real estate firm and a private individual had encroached upon a stretch of land earmarked for a 40-foot public road and started construction activity in violation of the approved layout.
The association said that despite multiple complaints and representations to the municipal authorities, no effective action was taken to halt the illegal activity. The residents approached the High Court seeking intervention to stop the construction and restore the road to public use.
Court orders enforcement with Police Support
Taking a serious view of the alleged violations, Justice Vijaysen Reddy directed the municipal corporation to initiate immediate enforcement action against those responsible and seek police aid from the local station if necessary.
The court also instructed officials to ensure full compliance with layout and planning regulations, warning that any laxity would be viewed seriously.
Corporation admits repeat violations
During the hearing, the standing counsel for the Badangpet Municipal Corporation informed the bench that the civic body had earlier carried out demolition activity based on the residents’ complaint. However, the violators resumed construction work soon after.
The counsel assured the court that fresh demolition and enforcement steps would be taken promptly to prevent further encroachments and safeguard public land.
Matter clubbed with similar petitions
After recording the submissions, Justice Vijaysen Reddy directed the corporation to act strictly in accordance with the law and ensure the layout is restored to its original state. The case has been adjourned to be heard along with similar petitions concerning illegal constructions in the Badangpet area.
