Uppal Congress MLA candidate requests cops for his criminal record, HC refuses to intervene
Parameshwar Reddy requested information on the criminal cases against him, if any, so that the same can be submitted to the election commission while filing nominations
By Newsmeter Network Published on 4 Nov 2023 4:05 AM GMTHyderabad: āIf you are confident that you are a genuine candidate, then you begin your canvassing in the elections. Why are you coming to the court, seeking a direction to the DGP to furnish your information,ā said Justice Bollam Vijaysen Reddy on Friday.
This was in response to a petition filed by Mandal Parameshwar Reddy who will be contesting from Uppal Assembly Constituency on a Congress MLA ticket for the ensuing Telangana Assembly elections. Parameshwar Reddy requested information on the criminal cases against him, if any, so that the same can be submitted to the election commission while filing nominations.
While refusing to order the DGP of Telangana to furnish information on criminal cases pending against Parameshwar Reddy, he directed the petitioner to show the provision of law under the CrPC which states that the particular information should be divulged to him.
The judge, while adjourning the writ petition to November 10, directed the GP for Home to get instructions on this issue as the counsel for the petitioner contended that the nomination of the petitioner would be rejected if such information is not furnished to the Election Commission.
The judge reminded the counsel for the petitioner about a case which was filed in the Supreme Court by a senior advocate under Article 32 saying that the information of criminal cases pending against his client should be uploaded to the police website. He said that the Supreme Court refused to issue such a direction, saying that there cannot be such a direction and further directed the senior advocate to show the provision under the CrPC, which says, such information can be divulged.
Hearing a similar case on Thursday, the Telangana High Court directed the Director General of Police (DGP) of Telangana to furnish information on criminal cases pending against Pampari Sai Prasad, BJYM national treasurer and an MLA ticket aspirant from the Malkajgiri Assembly Constituency for the ensuing Telangana Assembly elections.
