Plea in Telangana HC challenges graveyard construction inside Bandham Cheruvu FTL

Hyderabad: A Writ Petition has been filed before the Telangana High Court seeking action against what the petitioner describes as illegal construction of a graveyard within the Full Tank Level (FTL) limits of Bandham Cheruvu, situated in Survey No 32 of Khajipet Jagir, Khajipet Mandal, Warangal District.

According to the petitioner N Nagendar and 25 others, the respondents Subedari Mahaprastanam and GS Subedari Mahaprastanam, along with their associates, have allegedly undertaken graveyard construction adjacent to Revenue Colony, Widows Colony and Pragathi Nagar Colony in Hanamkonda without securing any permission from the competent authorities.

Allotment violates environmental norms

Despite several representations to the district and revenue officials, they allegedly failed to take action, prompting the present litigation, the petitioners alleged.

The petitioners further challenged the government’s earlier decision to allot Ac 3 of land within the FTL area of Bandham Cheruvu for graveyard purposes through proceedings, alleging that the allotment violates environmental norms and judicial precedents laid down by the High Court and the Supreme Court.

The plea urged the Court to declare the allotment as illegal, arbitrary and contrary to law, and sought a direction to demolish the structures raised by respondents 9 and 10 within the lake buffer zone.

The petitioner requested the court to issue any other orders deemed fit in the interest of protecting the water body from encroachment and preserving its ecological integrity.

Warangal municipality seeks time to file counter affidavit

In the Telangana High Court, the Standing Counsel for Warangal Municipality sought additional time to file the counter affidavit on behalf of the Municipal Commissioner in relation to the alleged illegal construction of a graveyard within the Full Tank Level (FTL) limits of Bandham Cheruvu in Warangal district.

Meanwhile, the Assistant Government Pleader for Irrigation and Command Area Development also requested time to place before the Court an official map of Bandham Cheruvu, clearly indicating the exact location of the graveyard said to be constructed within the tank’s perimeter.

The court, considering the requests of both counsels, adjourned the matter.
