Partha Dental Clinic asked to pay Rs 40k for no results in PFM treatment
By Newsmeter Network Published on 2 Oct 2020 8:16 AM GMTHyderabad: Rangareddy Consumer Disputes Redressal Forum has directed Partha Dental Clinic to pay a compensation of Rs 40,000 to a customer for causing “physical trauma and mental agony”.
The complainant, Y Lakshmi Kumari, resident of Uppal went to the Partha Dental Clinic, Peerzadiguda Branch, for treatment of her tooth.
Partha Dental Clinic after examination advised her to go for Porcelain-fused-to-metal (PFM) crowns for her teeth and collected Rs.40,000. But, even after treatment, there was no improvement.
“I went to another dental clinic. After examining, they stated that the earlier treatment was not proper. And they started from the beginning,” said Y Lakshmi Kumari.
The complainant requested the Partha Dental Clinic, to refund the amount paid. Late the clinic refunded the amount. The complainant requested them to provide a copy of the case sheet and the course of treatment.
“The present complaint is filed for compensation as I am still suffering from health issues as a result of the deficiency in the services of the clinic. I have spent a huge amount as a result of that,” said the complainant.
Partha clinic argued that there is no medical negligence.
After hearing arguments and going through the evidence and affidavit, the Forum said the dental clinic has accepted the negligence already by refunding the amount to the complainant.
“We can safely presume negligence on the part of the opposite party while rendering services to the complainant,” the Forum said.
The Forum ordered to pay Rs 40,000 as compensation to the complainant for causing physical trauma and mental agony. Besides, it asked to pay Rs.5,000 towards the cost of litigation.
