BRS MLAs defection case: SC takes up BJP’s plea, issues notice to Telangana Assembly Speaker again

BRS MLAs defection case: SC takes up BJP’s plea, issues notice to Telangana Assembly Speaker again

New Delhi: In a significant development in the case related to the defection of BRS MLAs in Telangana, the Supreme Court of India on Monday reissued notices to Assembly Speaker Gaddam Prasad Kumar.

The apex court had sent a contempt notice to the Speaker in the case last November.

The matter has now been posted for further hearing on February 6, adding fresh momentum to the politically sensitive case.

BJP flags non-compliance with earlier court orders

Hearing the matter, a Bench led by Justice Sanjay Karol took up a petition filed by the Telangana unit of the BJP and clubbed it with an already pending case on the same issue.

The BJP has alleged that despite clear directions from the Supreme Court to decide on the disqualification of defected MLAs within three months, the Speaker failed to act, amounting to wilful disobedience of court orders.

Contempt petition filed against Speaker

Seeking contempt action against the Speaker, Telangana BJP Legislature Party leader Alleti Maheshwar Reddy approached the apex court. The petition contends that the Speaker’s inaction has undermined the authority of the judiciary and delayed justice in the defection case.

Danam Nagender’s remarks cited

The petition also refers to recent media statements by Khairatabad MLA Danam Nagender, in which he reportedly stated that he continues to be with the Congress party. These remarks have been cited as relevant to the ongoing defection dispute.

Contempt notice was issued to Speaker in November

It may be recalled that the Supreme Court had issued a contempt notice to the Speaker as early as November last year.

With the BJP’s petition now formally tagged to the pending case and fresh notices issued, the matter has once again emerged as a major political and legal flashpoint in Telangana.
