Decision of the Governor to reject nominations of the petitioners and accept of Kodandaram and Amir Ali Khan is self-contradictory

Dasoju Sravan, Satyanarayana challenge Governor’s decision to reject their MLC nominations

Hyderabad: The Telangana High Court heard two writ petitions filed by Dasoju Sravan and K Satyanarayana, challenging the decision of the Telangana governor rejecting their nomination as MLCs under the Governor’s Quota.

The division bench, comprising Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti, allowed the interim applications filed by the petitioners impleading the two new MLCs P Kodandaram Reddy and Amir Ali Khan to the writ petitions.

Aditya Sondhi, senior advocate practicing in the Supreme Court of India, representing Dasoju Sravan Kumar informed the court that the governor Tamilisai Soundararajan rejected the nomination of D Sravan on the grounds that he is affiliated to the BRS party but the governor accepted the nomination of Kodandaram and Amir Ali Khan sent by the present Congress Government who too have political affiliations.

MLCs have political affiliations

The senior counsel contended that the decision of the governor rejecting the nominations of the petitioners and accepting the nominations of Kodandaram and Amir Ali Khan is self-contradictory.

The senior counsel said, “The same governor did not hesitate to make fresh appointments of Kodandaram and Amir Ali Khan, who have strong political affiliations.” He furnished a list of MLCs who were appointed by the governors of Andhra Pradesh, Bihar and Uttar Pradesh, under the Governor’s Quota, who had political affiliations and further contended that the governor, ought not have rejected the nominations of D Sravan and K Satyanarayana.

Mayur Reddy, senior counsel appearing for K Satyanarayana, informed the Court that the governor ought not to have rejected the nominations of the petitioner because the governor acts on the aid and advice of the council of ministers and if the governor rejected the nominations, then it implies, that the governor has rejected the recommendations of the council of ministers.

The status quo order on the notification on January 25, 2024, appointing P Kodandaram Reddy and Amir Ali Khan as MLCs under the Governor’s Quota will continue till this issue is finally decided in the court.

The Division Bench was adjudicating the two writ petitions filed by Dr Dasoju Sravan and Kurra Satyanarayana, whose names were recommended by the erstwhile BRS Government for the post of MLC under the Governor’s Quota and rejected by the governor.
