HC dismisses BSP MLA candidate’s plea seeking acceptance of poll nomination

Hyderabad: On Friday, the Telangana High Court dismissed a writ petition by a BSP MLA candidate seeking directions to the returning officer to accept their nomination.

The petition was filed by Manduri Sharada, a Bahujan Samajwadi Party MLA candidate contesting from Madhira (SC) Constituency in Khammam district.

Her election nomination was rejected by the returning officer on the grounds that the candidate had not filed the original Form A and Form B.

The Division Bench, comprising Chief Justice Alok Aradhe and Justice NV Shravan Kumar, after hearing the senior counsel Avinash Desai, appearing for the Election Commission of India (ECI) said that the process of election in the State of Telangana has already commenced and the High Court cannot interfere in this issue as per the Article 329B of the Constitution of India.

Moreover, the court reiterated the Returning Officer/RDO reasons for the rejection of Manduri Sharada’s nomination in an order dated November 13 that mentioned the missing documents.

“The petitioner has an alternative remedy for redressal of her grievance i.e., by filing an election petition,” the Court said, and dismissed the writ petition.
