Telangana HC dismisses plea against 42% BC quota in local body polls

Hyderabad: The Telangana High Court on Wednesday dismissed a writ petition challenging the State Government’s decision to allocate 42 per cent reservations to Backward Classes (BCs) in the upcoming local body elections.

‘Petition lacked official documents’

Justice Kunuru Lakshman, hearing the case, noted that the petitioners had neither filed the Government Order (GO) nor any official proceedings related to the reservations. Instead, they based their plea on newspaper reports.

The Judge cited Supreme Court rulings which clearly state that courts cannot act solely based on newspaper articles.

He observed, “This Court cannot take cognisance of such reports as per the principle laid down by the Supreme Court and therefore the petition is liable to be dismissed.”

Request for liberty declined

Senior Counsel Mayur Reddy, appearing for the petitioners, sought liberty to approach the court again with a fresh petition once the State issues a GO on the 42 per cent BC quota. However, Justice Lakshman declined the request.

Case filed by social activists

The petition was filed by Buttemgari Madhava Reddy, a social activist, and J Mallavva, an agriculturist. They argued that the reservation move was arbitrary and required judicial scrutiny.

With the dismissal, the government’s plan to provide 42 per cent reservations to BCs in the local body elections remains unchallenged for the moment.
