Telangana HC quashes MCC violation case against CM Revanth in Huzurnagar bypoll

Hyderabad: The Telangana High Court on Monday quashed a criminal case registered in 2019 against Chief Minister A Revanth Reddy in connection with alleged violation of the Model Code of Conduct during the Huzurnagar bye-elections.

Case background

The case was registered on January 19, 2019, at Garidepally police station, Huzurnagar, under Section 188 of the IPC against Revanth Reddy (Accused No 2) before he became the CM, and N Uttam Kumar Reddy, then MP from the Congress party (Accused No 1).

Police alleged that the leaders, along with other Congress members, conducted a meeting at Ponugodu mandal on October 19, 2019, without obtaining prior permission from election officials.

Following the investigation, police filed a chargesheet (CC No 403 of 2023) before the Principal Special Judicial First Class Magistrate for Excise Cases at Hyderabad.

Court’s observation

Justice Kunuru Lakshman held that offences relating to Model Code of Conduct violations are not legally maintainable in such circumstances. The court noted that the chargesheet did not contain any material to establish intentional disobedience by the petitioner.

Petition and relief

The order came in response to a petition filed by CM Revanth Reddy seeking to quash the proceedings in the case. Allowing the petition, the judge set aside the case in its entirety.
