Hyderabad: The Telangana High Court issued notices to the State government to explain reasons for ā€˜not introducing creamy layer for reservation among SCs and STs’ as per the judgement of the Supreme Court in the Devender Singh vs State of Punjab (2025) case

A Division Bench comprising Acting Chief Justice Sujoy Paul and Justice Yara Renuka on Monday issued notices to the principal secretaries to the Government, GAD and the Social Welfare Department, directing them to respond to the notices within six weeks.

The bench was adjudicating the writ petition filed by Kannukuntla Manga, an assistant professor working in a private college.

Her grievance before the court is that the Telangana Government has, though has come up with the Telangana Scheduled Castes (Rationalisation of Reservations) Act, 2025, has not introduced the creamy layer for reservations for SCs and STs as mandated in the judgment of the Supreme Court cited, due to which the educated SCs and STs are still lagging behind as the non-introduction of the creamy layer is robbing them of their government jobs.

ā€˜Lost employment opportunities’

Further, the petitioner contends that due to the non-introduction of the creamy layer aspect by the Telangana Government in the said act, the petitioner has lost a golden opportunity of getting selected for the post of child development project officer/additional child development project in the Women Development and Child Welfare Department.

In the recently concluded Group-1 examination held by the TGSPSC, her application for the said post was rejected only because of the non-introduction of creamy layer, despite the fact that the Supreme Court in the Judgment viz., Devender Singh vs State of Punjab, (2025) 1 SCC 1, clearly held that sub-categorisation amongst the SCs is permitted and further directed the States to introduce creamy layer but the Telangana Government has not yet introduced the same, due to which she has lost an opportunity to clinch the post.

Due to the non-introduction of the creamy layer in the said act, there will be no alleviation of the educated people hailing from SCs and STs, contended the counsel for the petitioner.

The hearing was adjourned for six weeks.
