Poachgate: TS files plea in HC seeking suspension of order for 4 weeks

Hyderabad: The Telangana government on Tuesday filed a lunch motion petition seeking to suspend the order of a High Court Single Bench dated 26 December 2022 for four weeks to file SLP in the Supreme Court.

Hearing the plea, a High Court Single Bench comprising Justice Bollam Vijaysen Reddy asked advocate general Banda Shivananda Prasad if they had taken permission from High Court Chief Justice Ujjal Bhuyan seeking suspension of order on the poaching case before coming to the Bench. Justice Bollam Vijaysen Reddy said there are some technical objections. He further said that when the Division Bench refuses to grant such relief, even by not giving any liberty to the state to move it before Single Judge, how can the Single Judge deal with it?

Justice Vijaysen Reddy further observed that it applies the doctrine of merger.

Advocate general Banda Shivananda Prasad informed the court that will take permission from the Chief Justice. The judge asked the deputy solicitor general Gade Praveen Kumar whether the CBI had registered an FIR.

The CBI has not yet registered the FIR. The state government has not responded despite the CBI writing letters three times, Mr. Praveen Kumar informed the court.

The advocate general informed the court that the state government is going to file SLP in the Supreme Court and the CBI is pressuring the state to hand over the case diary to register the FIR, which is illegal.

Justice Vijaysen Reddy asked how long it will take to go to the Supreme Court.

The AG replied it will take at least a week to file the plea in the Supreme Court.

Justice Vijaysen Reddy adjourned the issue for Wednesday and directed the AG to get consent form the Chief Justice, either written or oral.
