Vyuham: Telangana HC asks CBFC to reconstitute revising committee, review movie

A division bench of Chief Justice Alok Aradhe and Justice Jukanti Anil Kumar on Monday delivered its verdict on the two writ appeals filed against the single judge order.
The appeals were filed by Dasari Kiran Kumar and Director Ramgopal Varma against the single-judge order quashing the clearance certificate issued by the censor board.
The division bench perused the record of the revising committee submitted by the Additional Solicitor General of India. The committee has not assigned any reasons for granting a 'U' certificate to the movie with excisions. Therefore, the action of the Revising Committee in granting a 'U' certificate to the movie with excisions, in the facts and circumstances of the case, is in contravention of Rule 24(9) of the Certification Rules.
The court said it is held that the revising committee is required to assign reasons while granting a 'U' certificate to the movie with excisions. It is further held that no reasons have been assigned by the revising committee while granting a 'U' certificate to the movie with excisions.
The court also agreed with the conclusions arrived at by the single judge. Freedom of expression is a fundamental right in a democratic society which is governed by a rule of law. The Producer has a fundamental right under Article 19 of the Constitution of India which permits him to allude to true incidents with his perspective.
The court said the producer has invested money in producing the film and is also required to book the theaters in advance to ensure the release of the movie. The Chairman of the CBFC has already initiated the action for the constitution of the revising committee.
After perusing the facts of the case, the court directed that the Chairman shall re-constitute the revising committee, if not already constituted, which shall review the movie and duly communicate its decision for certification of the film to the appellants on or before February 9.
