YS Viveka murder case: Telangana HC adjourns Avinash Reddy’s bail hearing
The counsel for the petitioner, argued that in 2022, the CBI filed two chargesheets explaining the events before and after the death of YS Viveka
By Newsmeter Network Published on 28 April 2023 2:43 AM GMTTelangana: Telangana High Court adjourned the anticipatory bail plea hearing of Kadapa MP YS Avinash Reddy till Friday.
Avinash Reddy is an accused in the murder of YS Vivekananda Reddy.
Justice K. Surender heard the case and adjourned the matter till Friday.
T. Niranjan Reddy, counsel for the petitioner, argued that in 2022, the CBI filed two chargesheets explaining the events before and after the death of YS Viveka.
He said four circumstances in the case may be keenly observed. These include statements of Dastagir, now approver; Google Takeout; motive, and the destruction of evidence.
T. Niranjan Reddy argued that as per the prima facie investigation, even Dastagir was involved but was not arrested by the CBI. Moreover, he was with CBI in Delhi for over 2 months, which makes it clear that he agreed to illegal consignment and they granted him bail. Granting anticipatory bail to him is illegal.
The hearsay evidence in this matter is vague and CBI trusted it without any proof.
He said the statement of the deceased's daughter is with ulterior motives. “Except for the material gathered, there is no proof at all. And moreover, the CBI investigation is not fair and cannot go beyond Article 21, which has given fundamental rights to every citizen,” he said.
Siddharth Luthra, Sr Counsel, Supreme Court appeared for the deceased’s daughter. He said the AP government changed three SITs.
After the CBI took over the case, the matter has changed and real issues are coming out. There was a conspiracy executed and they tried to bring the deceased's death as a heart attack and later on something, Luthra argued.
He further submitted that for a fair and transparent trial of the case, bail may not be granted.
After hearing the arguments, Justice K. Surender Adjourned the matter till Friday.
