Hyderabad cops issue 41 A CrPC notice to MLA Raja Singh; likely to challenge Nampally courts release order

Hyderabad: The Shahinayathgunj and Mangalhat police stations, falling under Hyderabad Commissionerate, have issued 41(A) CrPC notices to BJP Goshamahal MLA T Raja Singh on 25th August, in regard to earlier cases. The notice gives police a green signal to arrest the MLA again.

In addition, the Hyderabad police are in the process to challenge the order of 14th Additional Metropolitan Court, that rejected Mangalhat's police's remand petition in the recent arrest of MLA Raja Singh, a senior cop told NewsMeter.

In the first notice issued by Shahinayathgunj cops, it stated, "On 4th April, 2022, we received a complaint from Sub Inspector G.Rajeshwara Reddy of Shahinayathgunj police station, against you for playing provocative song at Begum Bazar Chatri, Hyderabad on 10 April at about 8:00 PM during Sri Ramanavami Procession-2022". A case under section 153 (A), 295(A), 504, 505 (2) Indian Penal Code was booked against the MLA.

The second 41 A CrPC notice which was issued by Mangalhat police station, referred to a complainant filed in February 2022. It said, "A complaint referred from the Chief electoral officer and secretary to government of Telangana, against you (referring to the MLA) for making objectionable comments in a video which was widely circulated on various media platforms. The comments are utterly irresponsible and intimidating to the voters and have the undertone and propensity to undue influence the election in the state of Uttar Pradesh".

It is to recall, on August 23rd, amidst massive public outrage by the muslim community in Hyderabad. The 14th Additional Chief Metropolitan Magistrate court in Nampally, ordered immediate release of BJP Goshamahal MLA T Raja Singh over his derogatory remarks on prophet Mohammad. The legislator was given a 'don't repeat' warning and asked to submit a personal bond worth Rs 20,000.

Amidst public outcry, the court heard the arguments of both Sides. The judge opined that unless 41A CrPC notice was issued, police cannot arrest and reject the remand petition of Raja Singh. Further, the court opined that the remand procedure by the police was not proper, and the police do not comply with the condition of 41 CrPC. The court rejected Raja Singh's remand and directed the police to release Raja Singh immediately. However, I let him off with a 'don't repeat' warning. The two CrPC notices comes two days after Raja Singh's release

"Any other conditions, which may be imposed by the investigating officer/SHO as per the facts of the case. Failure to comply with the terms of this Notice, can render you liable for arrest under Section 41A (3) and (4) of Cr. P.C, the notice read.

The 41 A CrPC notice restricts MLA Raja Singh from

-You( referring to the MLA) shall not commit any offense in future.

-You shall not tamper with the evidence in the case in a manner whatsoever.

- You shall not make any threat, inducement, or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the court or to the Police officer.

-You shall appear before the Hon'ble court as and when required/ directed.

-You shall join the investigation of the case as and when required and will cooperate in the investigation.

- You shall disclose all the facts truthfully without concealing any part relevant for the purpose of investigation to reach to the right conclusion of the case.

-You shall produce all relevant documents/material required for the purpose of investigation. (h) You shall render your full co-operation/assistance in apprehension of the accomplice.

When it all started?

On the midnight of 22 August, Raja Singh had released a video on Shree Ram Channel-Telangana, a YouTube channel in which he made derogratory comments against Prophet Muhammad. This had disturbed the people belonging to Muslim community and massive protests were witnessed in several parts of the city including Dabeerpura, Humayun Nagar, Charminar, and near Hyderabad CP office in Basheerbagh.

In the video, Raja Singh had also abused comedian Munawar Faruqui and his mother, two days after the comedian's show in Hyderabad. It is important to recall that Raja Singh has attempted to disrupt Munawar Faruqui's show at Shilpakala Vedika in Hyderabad on 21 August.

Following a volcano of protests, Raja Singh was arrested by the Hyderabad City Taskforce and Shahithyagunj police on Tuesday morning. Later in the day, he was suspended from the BJP asking to show cause within 10 days on why he should not be expelled from the party.

Further Singh was taken to Nampally Criminal Court where he was granted bail.
