SSC paper leak: Telangana HC refuses to grant interim relief to Bandi Sanjay

Hyderabad: A Telangana High Court Division Bench comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji on Thursday afternoon heard the lunch motion petition filed by Bandi Sanjay, MP and Telangana BJP president, seeking to suspend the operation of the docket order 5 April passed by judicial magistrate first class magistrate at Hanamkonda, registered on the file of P.S. Kamalapur, Hanamkonda district, in the alleged SSC paper leak case.

The High Court issued notices to the state government and de facto complainant (headmaster, Boys School, Kamalpur) in the quash petition filed by Bandi Sanjay and adjourned it to Monday.

Meanwhile, the court has given liberty to petitioner Bandi Sanjay to file a bail petition before the lower court and the High Court.

The High Court has refused to pass any interim relief sought by the petitioner.

On behalf of the petitioner, Bandi Sanjay, senior counsel N. Ramachandra Rao argued that the petitioner has to attend the ongoing Parliament session and moreover, has to attend the Prime Ministerā€™s visit to Telangana on 8 April.

Mr. Ramachandra Rao further submitted that there is no case made out against the petitioner. The police did not follow the Arnesh Kumar case and took him around for about 300 km, moving him from one place to another in a police vehicle.

The court did not consider the request made by the senior counsel.

Banda Shivananda Prasad, the advocate general, submitted that there is a telephonic conversation between the petitioner and the other accused and said it is a big conspiracy to defame the government. Bandi Sanjay incited and encouraged the accused to leak and circulate the SSC papers to blame the government, the AG said. He should have handed over his mobile phone, he further submitted.

Bandi Sanjay Kumar, the Telangana Bharatiya Janata Party (BJP) head and MP who was detained by the Warangal police in the suspected SSC paper leak case were remanded to judicial detention until 19 April, sparking enormous protests from his followers across the state.

As a question paper from the class 10 (SSC) board test surfaced on groups of an instant messaging app, the Lok Sabha MP from Karimnagar seat was taken into preventive custody by a squad of police from his residence and then arrested in a case of malpractice.

BJP seeks Bandi Sanjayā€™s release

On Thursday afternoon, the Telangana High Court Division Bench comprising Justice Abhinand Kumar Shavili and Justice Pulla Karthik heard the House Motion petition filed by BJP seeking the release of Bandi Sanjay. The Bench issued a notice to the state government and adjourned the matter for four weeks.
