Telangana HC sends notice to 10 BRS MLAs for switching to Congress after 2023 polls
On Monday, the High Court Division Bench also issued notices to the speaker
By Newsmeter Network Published on 23 Sep 2024 2:51 PM GMTHyderabad: The Telangana High Court issued notices to 10 MLAs of the BRS party, who defected to Congress after the 2023 Assembly Elections, without resigning from BRS.
The defected MLAs who got the court notice are Danam Nagender of Khairatabad Assembly Constituency, Bandla Krishna Mohan Reddy (Gadwal), Kadiam Srihari (Ghanpur), Tellam Venkat Rao (Bhadradri Kothagudem), Pocharam Srinivas Reddy (Banswada), Kale Yadiah (Chevella), T Prakash Goud (Rajendra Nagar), M Sanjay Kumar (Jagityal), Gudem Mahipal Reddy (Patancheru) and Arekapudi Gandhi (Serilingampally).
On Monday, the High Court Division Bench, comprising Chief Justice Alok Aradhe and Justice Sreenivas, also issued notices to the speaker and the secretary of the Telangana State Legislative Assembly and the secretary of the Election Commission of India, New Delhi, directing them to respond to the notices by October 4.
During the course of hearing, the petitioner, Dr Kilari Anand Paul, president of the Praja Shanti Party, requested the court to pass an interim order directing all 10 BRS MLAs to ānot participate in the ensuing Assembly proceedings and not to exercise their power or right to voteā as such an action will be in violation of the provisions promulgated in the Tenth Schedule of the Constitution and the Representation of the People Act, 1951.
The Division Bench declined such a request as the petitioner could not apprise the court as to whether the Telangana State Assembly was in session or not.
