'Violation of Oath': AIMIM seeks expulsion of BJP MLA Raja Singh from Telangana assembly
By Newsmeter Network Published on 24 Aug 2022 9:45 AM GMTHyderabad : The All India Majlis-E-Ittehadul Muslimeen (AIMIM) party has written to the Telangana Legislative speaker, seeking expulsion of BJP Goshamahal MLA T Raja Singh from the house. The letter comes a day after the Saffron party's MLA passed derogatory comments in a youtube video against prophet Mohammad, resulting in widespread protest in Hyderabad and arrest of the legislator. He was later released on bail.
The letter represented by AIMIM General Secretary Syed Ahmed Pasha Quadri- MLA, stated, " Raja Singh's statement on Monday (24th August 2022) against the Prophet. Mohammed (PBUH) and Islamhas caused immense hurt to the sentiments of Muslims across India. It is a blatant violation of his oath as a member of the legislative assembly. The oath binds a member to bear "true faith and allegiance to the Constitution".
Secularism and fraternity are part of the basic structure of the Constitution of India. Raja Singh has repeatedly incited violence and promoted enmity, hatred and ill-will against Muslims. Thus, he has also violated his oath to uphold the "integrity of India". This statement is the most recent example proving that he is unfit to be a member of the house, the statement said.
The AIMIM pointed out that, The legislative assembly under Article 194 of the Constitution, has the authority to punish any person for breach of privilege and contempt of the House. And it includes the power to expel a member from the House.
The Kite party cited the judgment of the Supreme Court in Raja Ram Pal's and Ashish Shelar 2's case. "If Raja Singh is expelled, such proceedings will consonance with the rules of procedure and conduct of business,'' the letter said.
On August 22 night, Raja Singh posted a video on `Shree Ram Channel Telangana' wherein he made derogatory comments against Prophet Muhammad. He also abused comedian Munawar Faruqui and his mother. The video fuelled massive protests in the city. A complaint was registered against Raja Singh at Dabeerpura police station, hours after which Raja Singh was arrested. Hours later, Singh was produced before the 14th Additional Metropolitan court for communal disturbances, where he was granted bail as Hyderabad cops did not follow the 41 A CrPC procedure. All the sections slapped against Raja Singh were bailable offenses.
