Attention influencers: Here are new rules for social media content in Telangana

Hyderabad: In the wake of YouTuber Praneeth Hanumanthu's arrest, which has shed light on the misuse of social media, the Telangana State Commission for Women (TSCW) has issued "Directives for Responsible Content Creation and Influencing."

Praneeth Hanumanthu, a Telugu Youtuber made obscene conversations about a father-daughter relationship on a YouTube podcast. The content which many found grotesque, has led to widespread condemnation. He was further arrested by The Telanganaā€™s Cyber Security Bureau.

Follwing this, directives are designed to ensure that content adheres to legal, moral, and public order standards.

Need for Responsible Content Creation

Emphasizing the importance of responsible content creation, the Commission highlighted the fundamental right to freedom of expression under Article 19(1)(a) of the Indian Constitution.

However, this right is subject to reasonable restrictions under Article 19(2). The directives stress that while creative freedom should be honored, it should not compromise public order, basic decency, morality, or the laws of the land.

Chairperson's Statement

Nerella Sharada, Chairperson of the Telangana State Commission for Women, stated, "Public Order, Basic Decency & Morality should be prioritized by content creators across platforms, as stated in Article 19(2)."

She emphasized that content should not amount to an offense under existing laws concerning the safety of women, and the Commission reserves the right to take strong action against offenders.

Guidelines for Content Creators

The directives issued by the Commission include:

1. Adherence to Article 19(2): Content creators must prioritize public order, basic decency, and morality as stated in Article 19(2) of the Indian Constitution.

2. Compliance with Existing Laws: Content should not amount to an offense under existing laws concerning the safety of women. Violators will face prosecution.

3. Understanding Reasonable Restrictions: Creators must be well-versed with the reasonable restrictions on freedom of expression and abide by them.

4. Non-Interference with Laws: Content should not affect the operation of any existing law or prevent the State from making any law.

5. Avoiding Defamation and Violence: Content should not be defamatory or incite violence in any manner.

6. Upholding Social and Secular Fabric: The sanctity of the social and secular fabric of the state should be upheld at all costs.

7. Avoiding Misinformation: Spreading misinformation or unverified conspiracy theories without expressly mentioning them can make the individual liable for prosecution.

8. Preventing Sexual Harassment: Outraging the modesty of a woman, sexual harassment, and inciting violence against individuals or communities are criminal offenses and will be prosecuted.

9. Respecting Sentiments: Content should not belittle any person, group, gender, community, or sex unless supported by facts.

10. Using Influence Responsibly: Influencers must fulfill their responsibility to their followers and use their influence for the right cause.

Understanding Boundaries in Comedy

Sharada also addressed the subjective nature of comedy, stating, "As subjective as the definition of 'comedy' or 'dark comedy' could be, the individual is expected to have an understanding of where to draw the line."
