Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) revoked the registration of a defaulting promoter in 2024 and facilitated the successful completion of a long-stalled residential project by the Association of Allottees.

The Authority declared that the project ‘Jaya Platinum’ has now been lawfully completed following the issuance of the Occupancy Certificate on January 5.

What is the case about?

The case pertains to the residential project Jaya Platinum, developed by Jayathri Infrastructures India Pvt. Ltd. at Bowrampet Village, Dundigal Municipality, Medchal–Malkajgiri district.

Spread over 2,731.78 square yards, the project consists of a stilt plus five floors with a total of 60 apartments and was registered with TG RERA.

Homebuyers complain of delayed construction

A batch of complaints was filed by the allottees under Section 31 of the Real Estate (Regulation and Development) Act, 2016, alleging prolonged delay and complete stoppage of construction since June 2022.

The complainants stated that despite selling over 50 units and registering 49 sale deeds, the promoter failed to complete the project within the promised timeline, causing severe hardship to buyers.

No credible financial plan found

During the final hearing, the promoter failed to appear despite due notice and was set ex parte.

TG RERA noted that although the promoter initially cited contractor disputes and financial distress, no credible financial plan or construction roadmap was submitted even after multiple opportunities.

Independent technical assessment

To ascertain ground realities, TG RERA ordered an independent inspection by the Engineering Staff College of India (ESCI).

The ESCI report revealed that only 66 per cent of the project was completed, construction had remained completely stalled since June 2022, and there was a serious mismatch between claimed expenditure and actual physical progress.

The report concluded that at least 12 months would be required to complete the remaining works, subject to uninterrupted funding.

Pattern of repeated defaults

The Authority took serious note of the promoter’s regulatory history, observing that more than 200 complaints were pending against the same developer across multiple projects for violations of RERA provisions, including delays, non-compliance and financial indiscipline.

Revocation of Registration

Based on the findings, TG RERA initiated proceedings under Section 7 of the Act and formally revoked the project registration on April 30, 2024, declaring the promoter a defaulter.

The Authority concluded that the promoter lacked financial capacity, technical preparedness and regulatory credibility to complete the project.

Allottees take over under Section 8

Invoking Section 8 of the Act, TG RERA, after consulting the Government of Telangana, permitted the JP Welfare Association, the registered Association of Allottees, to take over and complete the project.

Over 90 per cent of the allottees consented to this move and agreed to contribute funds under strict regulatory supervision.

Project completed, OC issued

Following the takeover, the Association successfully completed the remaining construction in compliance with all statutory requirements.

The competent authority issued the Occupancy Certificate on January 5, certifying that the building conforms to sanctioned plans and is fit for occupation. With this, the long-standing uncertainty faced by homebuyers came to an end.

Mortgaged units and conveyance deeds

TG RERA noted that nine flats had been mortgaged with the local authority during construction. Upon release of these mortgaged units, the promoter has been directed to execute and register conveyance deeds in favour of the concerned allottees within 30 days, failing which penal action will be initiated under the Act.

The Authority clarified that the Association of Allottees will bear no liability related to these mortgaged units and all statutory obligations remain with the promoter.

Regulatory appreciation

TG RERA placed on record its appreciation for the Association of Allottees for completing the project with transparency, financial discipline and collective responsibility, calling it a model example of effective homebuyer-led completion under the RERA framework.

Final order

Declaring the project lawfully completed, TG RERA disposed of the complaints with no order as to costs, while reiterating that the promoter’s past liabilities and statutory obligations remain enforceable under law.
