Hyderabad: Telangana Real Estate Regulatory Authority (TGRERA) has imposed a penalty of Rs 27 lakh on Googee Properties Pvt. Ltd. for selling and promoting plots in its proposed `satellite township' at Nomula village, Ibrahimpatnam mandal, Rangareddy district, without securing mandatory approvals or registering the project.
Action following buyersā complaints
The penalty follows complaints by Sumalatha Kamireddy and 11 others, who alleged that the developer collected substantial advances under a `pre-launch offer' despite lacking statutory clearances.
TG RERA found that each complainant booked a 200-square-yard residential plot through a memorandum of understanding or agreement of sale and paid significant advance amounts.
Over two years later, the site remained undeveloped, with no demarcation of plots.
Mismatch between claims and records
Promotions touted the venture as a 1,000-acre integrated township, but official records showed only 334 acres and 29 guntas in the layout. Of this, the developer owns merely 30 acres in `Phase II ā Business Class'.
TG RERA concluded that Googee Properties had neither registered the project under Section 3 of the Real Estate (Regulation and Development) Act nor obtained layout approval, despite repeated assurances to buyers.
Refunds with interest ordered
Along with the penalty, TG RERA has ordered the developer to refund the amounts paid by all 12 complainants, with 10.8% annual interest calculated from the date of booking until repayment, under Rule 15 of the Telangana RERA Rules.
The authority has also directed Googee Properties to immediately stop all sales and marketing activities until the project is duly registered. The refunds and penalties must be cleared within 30 days.
