Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) has penalised city-based RR Constructions with a fine of Rs 2.81 lakh for failing to register its residential project, Sree Vajra Residency, located at Lalitha Nagar in Adikmet.

In its order issued on July 1, TGRERA also directed the builder to immediately apply for an Occupancy Certificate (OC) and provide it to the association of flat owners.

Resident’s complaint exposes violations

The action was initiated based on a complaint by Mudrakartha Veenadhari, a resident of Flat No. 302 in Sree Vajra Residency. She stated that despite repeated requests, the builder did not provide any proof of having applied for an OC.

Following this, she verified with GHMC Secunderabad Zone authorities and found that no application had been made in the two and a half years since construction was completed.

Construction exceeds sanctioned plan

Veenadhari also alleged that RR Constructions built 10 flats on the site, although the sanctioned building plan permitted only eight flats, amounting to an unauthorised deviation under the RERA Act, 2016.

Quality issues flagged

Apart from the registration issue, the complainant raised concerns about poor construction quality, including water stagnation in the parking area due to inadequate slope and lack of rainwater shades, inferior internal and external painting prone to discolouration and stains, substandard plumbing and sanitary fittings requiring premature replacement, poor plastering that causes cement patches upon minor impact and fungal growth posing health risks and non-functional transformer in the premises.

Builder denies allegations

In his response, the builder denied all allegations and claimed the complaint was an abuse of legal process, demanding its dismissal with exemplary costs.

Penalty imposed with rectification orders

After examining the submissions, TG RERA chairman N Satyanarayana, along with members K Srinivas Rao and Laxmi Narayana Jannu, held that the builder was liable under the RERA Act. RR Constructions has been ordered to pay a penalty of Rs 2,81,276 within 30 days.

Additionally, the builder has been directed to rectify water inundation issues and ensure the transformer is made functional within 30 days of receiving the order.
